Are Gel Ball Guns Legal in Queensland

Queensland is one of the few states and territories where it is legal to own a yellow truck without a license. A gel blaster is considered a “firearm” in Victoria and, as such, it is illegal to possess or use a gel blaster unless you have a valid firearms licence. Owning or using a firearm without a firearms licence in Victoria carries penalties of up to two years in prison in local district court for summary firearms-related offences. Tougher penalties apply to more serious firearms offences dealt with by higher courts. Victoria`s Firearms Acts define a firearm as a device designed to discharge a shot, bullet or other missile by the expansion of gases produced by the ignition of highly flammable materials or by compressed air or other gases, whether mechanically stored in the device in pressure vessels or in the device. in accordance with section 3 of the Firearms Act 1996 (Vic). The same gun laws apply to yellow trucks in Melbourne. Yellow trucks are identical to various handguns, shotguns and rifles from around the world. The color, size and detail of these yellow trucks make it difficult for anyone to notice the difference between a toy and a real gun.

With the exception of Queensland and South Australia, it is illegal to possess or use an air pistol, BB pistol or blaster gel weapon in any other state or territory of Australia unless you have a valid firearms licence or licence. In New South Wales, these types of weapons are defined as “firearms” under section 4 of the Firearms Act 1996 (NSW) (“Firearms Act”). Airsoft pistols, BB pistols and gel blasters are spring-operated and/or use compressed air to feed a projectile without the means of an explosive.
